1 Nthing Abut Us Withut Us Agenda Setting Wrkshp and Cnsultatin Frum n Crss-Sectral Disability Inclusin Jakarta, 3-5 June 2013 Facilitated and reprted by Galuh Wandita (AJAR) and Herizal Arifin BACKGROUND As a cncrete step after the Gvernment f Indnesia ratified the UN Cnventin n the Rights f Persns with disabilities in Nvember 2011, the Crdinating Ministry fr Peple s Welfare (Kemenk Kesra) and the PNPM Supprt Facility spnsred a cnsultative frum t discuss crss-sectral disability inclusin strategies within cmmunity empwerment prgrams. The tw and ne-half day cnsultative gathering aimed t: 1. Prvide an pprtunity fr rganizatins and persns with disabilities in Indnesia t share their aspiratins, experiences, and challenges in advcating fr the rights f persns with disabilities at bth grassrts and higher plicy levels 2. Obtain inputs n a Multi Stakehlder Frum cmpnent in the PNPM Disability Prgram (PNPM DPO Windw), including building a shared visin abut gals, pririties, frum membership and rganizatinal structure 3. Develp an agenda and fllw up plans fr the Multi Stakehlder Frum T ensure full participatin f persns with disabilities, the Disabled Peple Organizatins (DPOs) were given ne and ne-half day frm June 3 rd t 4 th t identify, discuss and priritize issues fr the agenda during the preparatry frum n June 5 th. Disability activists, rganizatins f persns with disabilities, disability-specific rganizatins, nngvernmental rganizatins, relevant gvernment representatives and dnr agencies attended this preparatry sessin. DPO-Oriented Wrkshp, June 3 rd and 4 th Intrductin and Expectatins Day One (June 3) sessin included intrductins, participants expectatins n wrkshp, wrkshp rientatin (such as agreement n schedule and guidelines fr participatin). On Day Tw (June 4 th ), the wrkshp cntinued with brainstrming ideas abut the Multi Stakehlder Frum. The discussin revlved arund structure, agenda, and membership f the frum. The frum is envisined as a means fr persns with disabilities push and mnitr fr rights based disability inclusin as mandated by the 1945 Cnstitutin and the UN Cnventin n the Rights f Persns with Disabilities. 2. Mapping: bstacles, achievements, and strengths f DPOs This sessin started with paired discussin t answer questin What are ur challenges, achievements and strengths and map the experiences f DPOs. Presentatin f Results frm the DPOW Scping prir t Multi Stakehlder Frum This sessin explained the MSF cmpnent within PNPM DPO Windw and allwed DPOs t ask questins and understand where DPO Windw stands within umbrella PNPM Mandiri. Summary n Initiative fr Establishment f Multi Stakehlder Frums (MSF) The cnsultatins and preliminary DPO Windw field findings cnfirmed the need fr a mre unified disability inclusin strategy and wrk plan acrss the gvernment, key ministries, internatinal and lcal dnrs, civil sciety and academic sectrs in Indnesia. It als highlighted the imprtance f invlving DPOs in the initiative and led t frmatin f a multi stakehlder frum. The frum is envisined as ne f crucial strategies t ensure substantive cllabratin and crdinatin f resurces amng many disability prgrams in Indnesia. The MSF will enable DPOs t increasingly play key rles in shaping and imprving disability inclusin prgrams and cnnect the DPOs t the highest levels f gvernment thrugh the strategic versight and management f Menk Kesra under technical assistance f PNPM- DPOW (Disabled Peple Organizatins Windw). ISSUES FOR CONSIDERATION The cnsultatins identified a number f key issues that affect existing disability-related prgrams: Nn-existent infrmatin n (grassrts) DPOs utside Jakarta and Java island Lack f access t funding infrmatin and resurce fr DPOs Lack f cmmunicatin and clear rles n wh shuld be ding disability amng key ministries Lack f effective and integrated natinal plicies t address disability inclusin amng varius gvernment s scial develpment prgrams Lack f dnrs crdinatin as evidenced by parallel prgrams in sme areas Limited and weak netwrks amng DPOs, which hampers mre intensive and meaningful participatin f DPOs at bth grassrt and plicy level advcacy Page 4 f 21

5 The need fr crdinatin between central and reginal gvernments t prmte rganizatinal capacity f DPOs Althugh the CRPD has been ratified, many prgrams still see persns with disabilities as beneficiaries, rather than key players The need fr affirmative actin fr persns with disabilities Lack f cnsensus n definitin f persns with disabilities the gvernment and DPOs need t meet and agree n this issue 4. Critical Discussin What is the Multi Stakehlder Frum fr? The DPOs participants critically questined the purpse f establishing a multi stakehlder frum. Althugh sme participants frm the natinal umbrella DPOs based in Jakarta felt the imprtance f this initiative under the Crdinating Minister fr Peple s Welfare, they are cncerned as t hw the frum may verlap with existing cnsultative frums. What relatinship exists between this frum and the Natinal Actin Plan (Rencana Aksi Nasinal) crdinated by the Ministry f Scial Affairs (Menss). Deep discussin ensued n whether DPOs rle will be as participants in this frum r as wrking partners. The grup agreed that it is imprtant t: determine main gals t be realized thrugh the PNPM-DPOW initiative define hw this prgram differs frm ther disability targeted prgrams. Sme participants suggested that the gal and fcus f this prgram shuld pertain t areas and issues that have nt been addressed by ther existing prgrams Page 5 f 21

6 if pssible, align the wrks f PNPM DPOW with ther existing disabilities prgrams under ther Ministries/Agencies, fr instance, the Ministry f Scial Affairs, Ministry f Freign Affairs, TNP2K and thers t avid reduplicatin and stagnatin f prgram activities align MSF with the framewrk f Natinal Actin Plan, including prcesses and implementatin A wrking grup was tasked t frmulate agenda and mechanisms fr discussin at the Preparatry Wrkshp n June 5 th The grup envisined the scpe f prcess, issues t be addressed, stakehlders and ptential participants and the cnstraints f the frum and its prcesses. 5. Outcmes f DPOs Wrkshp Pririty Issues Stigmatizatin and discriminatin tward persns with disabilities Weak legal instruments and access t justice fr victims with disabilities Lack f DPO mainstreaming and funding fr capacity building Inadequate attentin t persns with disabilities in cnflict areas, wmen and children with disabilities Limited access t infrmatin (e.g., t sign language interpreters) and access t persns with disabilities as resurce persns Lack f Assistive (Device) Technlgy t supprt persns with disabilities Lack f access t educatin, livelihd pprtunities and jb and skills training, alng with crdinatin supprt frm relevant agencies Lack f quality research n disability issues in academia Gaps and lack f crdinatin and cmmunicatin amng DPOs inside Java and utside f Java Limited DPOs existence in Eastern Indnesia Lack f dedicated funding allcatin fr prgrams targeting persns with disabilities and budgeting prcess nt transparent and disability inclusive Recmmendatins n MSF Establishment The MSF is seen as necessary t bring tgether stakehlders frm varius sectrs and diverse actrs, particularly DPOs and persns with disabilities t address the abve mentined issues. The main functins and scpe f MSF need t encmpass: 1. Crdinatin that include clear and infrmed wrk plans; 2. Mechanisms t address the capacity gap between DPOs in Java and Eastern Indnesia. The frum is expected t serve t bridge the gap by frming a special cluster t prmte the capacity f DPOs in the eastern regins; and, 3. Mechanisms t enable DPOs t implement mnitring and evaluatin f disability inclusiveness f prgrams fr peple with disabilities and ther pverty reductin prgrams All DPO representatives in this cnsultative sessin were highly enthusiastic abut being invlved in the MSF. Althugh thse attending this meeting maybe identified by thse invlved in fficial planning, thers with interests at stake that have yet t be identified r experience high level frum might be verlked. In rder t mitigate the risk f exclusin and balancing different views, the utreach shuld be directed well beynd natinal umbrella rganisatins and utside Java as much as pssible. There shuld be ample pprtunity fr CSOs, businesses, and ther interested parties t self-identify. Page 6 f 21

7 The selectin f MSF members, like the prgram design and planning, ideally shuld happen prir t the actual MSF. Sme f the suggestins regarding the selectin prcess fr MSF membership include: 1. Selectin Cmmittee it will be neutral and members will nt participate in the MSF 2. Open and transparent prcess, where each DPO submits rganizatin s CV fr review by the Selectin Cmmittee. 3. Special mechanism t enable each DPO t participate and cntribute t the MSF 4. Peridic evaluatin n MSF members perfrmance every six mnths Remarks Matters t be immediately addressed: (1) Agreement n definitins f Disabled Peple Organizatins, and (2) creatin f a mailing list fr the frum B. Agenda Setting Multi Stakehlder Frum June 5 th, 2013 Stakehlders f disability inclusin and issues cmprised f relevant gvernment agencies, DPOs, NGOs, media, academia, and dnr agencies gathered fr the wrkshp n day three. In his pening speech, Sujana Ryat, the Deputy Crdinating Ministry f Peple s Welfare and Natinal Prgram fr Cmmunity Empwerment (PNPM Mandiri) shared his perspective as well as sme f the gvernment effrts n disability inclusin and key reasns why the MSF is crucial in rder t build and strengthen disability inclusin in crdinated and strategic way. Accrding t Sujana Ryat, existing strategy fr pverty alleviatin has yet t cnsider and place persns with disabilities and DPOs as develpment actrs hence Kemenk Kesra tk the initiative t address inclusin f persns with disabilities within the Natinal Prgram fr Cmmunity Empwerment (PNPM) DPO Windw. The DPO Windw is nt a charity-based prgram but rightsbased and scial justice platfrm fr peple with disabilities and DPOs t advcate fr their inclusin within scial develpment and pverty reductin prgrams. During the Questin & Answer sessin, several participants raised similar suggestin n strategies that fster cmmunity and sciety s understanding and acceptance tward peple with disabilities thrugh upward spiral and sustained advcacy, inclusin f disabilities awareness in schl curricula and increasing implementatin and safeguarding f natinal and lcal regulatins that prtect and guarantee the rights f peple with disabilities. Presentatin f DPO Frmulatin Antni Tsaputra, West Sumatera Indnesian Disabled Peple s Assciatin (PPCI) representative, delivered a map f issues t be priritized, ratinale and recmmendatins that the DPO participants had brainstrmed. The identified prblems are categrized int three spheres, namely plicy (regulatin, prgram, handling r respnse f the gvernment case-by-case); structural (behavir and practices in the administratin f state services by state agents), and cultural (behavir and wrldview f the sciety). The presentatin was fllwed by a series f panel presentatin n Services fr Children with Disabilities in Remte Regins by Subasn frm Bhakti Luhur Fundatin in Malang, Cases f Vilence Against Wmen with Disabilities in 3 Prvinces by Nurul Andriani frm SAPDA, The Difabled Yuths by Serafina Bete frm Persani, Kupang and Livelihds Opprtunities fr persns with disabilities by Nurlaili Ramdani drm LP3C Sumbawa. 9 4. Grup Discussin n Frmulating the Agenda fr Multi Stakehlder Frum. The wrkshp participants were divided int fur grups: Scial Prtectin and Assistance, Emplyment and Skills Training Issues, Accessible Infrastructure and Educatin. Each grup was cmprised f representatives frm DPOs, gvernment agencies, NGOs, and dnrs. The facilitatrs prvided the grups with guiding questins: 1) What is the lng-term gal f MSF? 2) What agenda r prgram t be priritized in MSF? 3) What are expected utcmes frm nging 2-year MSF? 4) What are the mechanisms fr participatin, accuntability, and cmmunicatin in the MSF? 5) What ther issues t bring int the table? Detailed discussin results frm each grup can be fund in Appendix Reflectins frm Facilitatrs In this sectin, we attempted t summarize the ideas fr the Multi Stakehlder Frum design based frm discussins abve. A. Main agenda Identifying needs, mnitring and evaluatin and prvide gd practice guidelines (success stries and awards t varius gvernment agencies, cmpanies, universities and private sectrs that meet 1% quta f emplying peple with disabilities) Prmte legalizatin and implementatin f reginal disabilities regulatins and laws (UU PERDA) Campaign fr full access and participatin f DPOs in planning and budgeting prcesses thrugh Musrenbang, including mnitring the implementatin mechanisms Increase the rganizatinal capacity f DPOs C. RECOMMENDATION The recmmendatins belw are based n the facilitatrs bservatin during discussin prcess and dynamics f interactins amng DPOs themselves and with thers. 1. DPO Windw shuld prmptly implement a number f fllw up cmmitments agreed at the end f the wrkshp t maintain the trust, interest and enthusiasm f participants pstwrkshp and speed up the establishment f the MSF. The wrkshp results and reprts shuld be distributed when ready and create mailing list s participants can cme up with ideas hw t further develp the capacity f DPOs thrugh MSF. 2. After the establishment f the MSF, it is imprtant t cnsider placing DPOs grup as the frefrnt f disability inclusin prgrams at bth natinal and reginal level because they understand disability inclusin better. Kemenk Kesra as MSF leading versight states in his pening speech: A strng rganizatin is defined by the strength f its stakehlders at the lwer levels. The gvernment will prvide all types f necessary supprt necessary, but will restrain itself and will nt be invlved t deeply because the realizatin f aims f this prgram entirely depends n the aspiratins and decisins f persns with disabilities and DPOs themselves. 3. PNPM DPO Windw shuld cnsider the MSF as a strategic frum r mechanism nt as prgram delivery. It is imprtant t build understanding and acceptance amng the sciety and the state tward persns with disabilities thrugh: (1) upward spiral and sustained advcacy, (2) inclusin f disabilities awareness in schl curricula, and (3) increased implementatin and safeguarding f natinal and lcal regulatins that prtect and guarantee the rights f peple with disabilities. 4. Building n the ideas suggested by the DPOs, PNPM DPO Windw needs t cnsider an pprtunity t synergize with ther disability prgrams cnducted by ther gvernment ministries, such as the Ministry f Scial Affairs, Ministry f Freign Affairs, TNP2K, etc. This effrt needs t be carefully cnsidered in rder t avid duplicatin and delay in prgram activities. DPOs expect t play crucial rle in MSF, bth in prcess and implementatin stages t ensure that existing disability inclusin prgrams can be aligned with natinal and internatinal rights-based laws and Natinal Actin Plan (RAN).
