Information The information provided in this Technical Information is the ones which have high relevance with the work of BKI. 3 BRIEF INFORMATION OF IMO MARITIME SAFETY COMMITTEE SESSION 96 (MSC 96) A. CONSIDERATION AND ADOPTION OF AMENDMENTS TO MANDATORY INSTRUMENTS (AGENDA ITEM 3) Maritime Safety Committee 95 th session discussed and approved the following draft amendments to mandatory instruments: 1. SOLAS Chapter II-2 2. The International Code on the Enhanced Programme of Inspections during Surveys of Bulk Carriers and Oil Tankers (ESP Code) The International Code for Fire Safety Systems (FSS Code) 4. The International Convention on Standards of Training, Certification and Watchkeeping for Seafarers (STCW) The Seafarers' Training, Certification and Watchkeeping (STCW) Code 6. Code for the Construction And Equipment of Mobile Offshore Drilling Units 2009 (MODU Code 2009) 7. The International Maritime Dangerous Goods (IMDG) Code 8. The International Code on Intact Stability, 2008 (IS Code 2008) Following the decision taken by MSC 95, the Committee established the Drafting Group to finalize the draft and submit the report accordingly. After the lengthy discussion, the Drafting Group finalized the draft amendments and approved by MSC 96. Following the approval, the amendments to mandatory instruments are adopted and expected to enter into force on 1 January However, the amendments to ESP Code, IMDG Code, STCW Convention and STCW Code are expected to enter into force on 1 January In addition to above amendments, the Committee also adopted the amendments to the following MSC Circulars to support the amendments to IMDG Code: 1. MSC/Circ.1025 (Revised Emergency Response Procedures for Ships Carrying Dangerous Goods (EmS Guide)) 2. MSC.1/Circ.1442 (Inspection programmes for cargo transport units carrying dangerous goods) B. MEASURES TO ENHANCE MARITIME SECURITY (AGENDA ITEM 4) Maritime Cybersecurity MSC 94 had considered issue on maritime cybersecurity and the importance for ships in preparing for cyberthreat. Following discussions made during MSC 95, The Committee reaffirmed that cybersecurity was an important and timely issue. MSC 95 therefore welcomed Member States, international organizations, and industry to cooperate in developing the guidelines on cybersecurity on board ships, with expectation to be submitted to FAL 40 and MSC 96. In MSC 96, industry represented by ICS, IUMI, BIMCO, INTERTANKO, CLIA and INTERCARGO submit The Guidelines on cybersecurity on board ships that were published in January 2016 with updated version 1.1. The Guidelines is specific for onboard ship application and intended to support shipowners in preparing procedures and plans of action pertaining to maritime cybersecurity with approach of risk Attachment of Technical Information No: Page 3 of 15

4 assessment. The full text of the Guidelines can be accessed through Several Member States also deposited their submission on the issue of maritime cybersecurity proposal and measures aimed at improving cybersecurity onboard ships. During the discussions in working group, it was agreed to use Guidelines for Cyber risk Management submitted by Canada, Japan, Liberia, the Marshall Islands, Norway and United States as the basis. MSC 96 finally approved Interim guidelines on maritime cyber risk management as MSC.1/Circ Guidance for the development of national maritime security legislation Since the implementation of ISPS Code on 1 July 2004, the challenges for enactment persist due to a number of aspects, among other things, the existence of comprehensive national legislation. In 2012, IMO published Guide to Maritime Security and the ISPS Code (GMSIC) to assist maritime security stakeholders. This Guide also reiterate the need to specify the powers needed for Government officials to undertake their duties, including the inspection and testing of security measures and procedures in place at ports and port facilities and on ships, and the application of enforcement actions to correct incidents of non-compliance. The Committee at this session approved the Guidance for the development of national maritime security legislation as MSC.1/Circ.1525, highlighting whilst the structure of the Guidance provides clear distinction between mandatory requirements and guidance, the Guidance itself has to keep its recommendatory nature. MSC 96 invited Member Governments willing to use the Guidelines for the development of their own national maritime security legislation, on their necessity to seek technical assistance from the Organization. C. GOAL BASED NEW SHIPS CONSTRUCTION STANDARD (AGENDA ITEM 5) GBS audit verification reports SOLAS Regulation II-1/3-10 as amended by MSC Resolution 290(87) requires oil tankers and bulk carriers that have building contract is placed on or after 1 July 2016, or in absence of building contract, the keels of which are laid or which at a similar stage of construction on or after 1 Juli 2017 or the delivery of which is on or after 1 July 2020 to be designed and constructed in compliance with GBS. This regulation requires the rules for construction to be verified by IMO in accordance with Guidelines for verification as in MSC Resolution 296(87). Since then, 12 Recognized Organization (RO) had been audited and reported to MSC 96 with following highlights: 1. From the 13 ROs which deposited application, one RO initiated to cancel its initial verification audit process. 2. The findings from the audit reveals 6 non-conformities and 88 observations. 3. The 12 ROs already submitted their rectification plan which will be started on 1 June 2016, and further will be reflected by amandments of their rules on December 2016 iwith expected enter into Attachment of Technical Information No: Page 4 of 15

5 force on 1 July MSC 96 approved the rectification plan and confirmed that all construction rules from those 12 ROs comply with IMO goal based new ship construction standards for bulk carriers and oil tankers. Revised timetable and schedule of activities for the Implementation of the GBS verification scheme Considering the result of GBS initial verification audit, MSC 96 revised the time table and schedule of activities for the implementation of GBS verification scheme, as follows: Timeline Action May 2016 MSC 96 takes final decisions on conformity with GBS for all rules submitted MSC 96 circulates appropriate MSC circular to Member Governments Secretariat maintains list of all rules verified to conform to Standards MSC 96 agrees on the revised timetable and schedule of activities for the implementation of the GBS verification scheme Secretary-General notifies the relevant Administrations/ROs of MSC's decision 1 July 2016 GBS SOLAS amendments (and Standards) become applicable November 2016 MSC 97 reconsiders the verification process and funding mechanism, and initiates the amendments to GBS Guidelines, taking into account the observations provided by the audit teams (MSC 96/5/2). 31 December 2016 Deadline for the receipt of new self-assessment and verification request for the rectification of non-conformities, as well as the status of addressing of observations January 2017 to Secretariat organizes verification audit for the rectification of non-conformities March 2017 and finalizes report March 2017 Secretariat prepares documentation on audit for the rectification of nonconformities and the status of addressing of observations June 2017 MSC 98 confirms that the non-conformities are rectified and circulates appropriate MSC circular to Member Governments MSC 98 finalizes the amendments to part A on verification process to the GBS Guidelines for future audits MSC 98 takes decisions on the funding mechanism for future audit Secretariat maintains list of all rules verified to conform to Standards 31 December 2017 Deadline for the receipt of rule change information and request for new initial verification audits, if any January 2018 to Secretariat organizes audits of rule changes, ad hoc rule change audits and June 2018 new initial verification audits as may be requested Secretariat processes any appeal requests July 2018 Secretariat prepares documentation on annual audits (if any), ad hoc rule Attachment of Technical Information No: Page 5 of 15

6 November 2018 change audits and new initial verification audits MSC 100 finalizes the amendments to part B on information/documentation requirements and evaluation criteria of the GBS Guidelines MSC 100 takes decisions on annual audits, ad hoc rule change audits and new initial verification audits Further works concerning Industrial Standards (IS) for Ship Construction Files (SCF) An information package to be included on IMO GBS standards is ship construction files SCF that shall be stored along ship s life, including all changes and modification of ship structure, if any. In order to give practical guidance related to SCF implementation on shore or onboard ship and the transparancy access of the data by ship owner, classification societies and administrator of Flag states can be carried out, the industry has developed an industrial standards for SCF. The important issue of the SCF s industrial standards are: 1. Intelectual properties (IP) right as described in SCF documents & data, : a. High IP level b. Ordinary IP level c. This IP level issue is a process by considering the approval from ship owner and IP holder (generally, ship designer or shipbuilder). 2. The development of archieve center on shore is conducted in order to place the SCF file by using digital format. Archieve center is a backup data location of all SCF data/documents (ship onboard and/or onshore) Further works concerning Interim Guidelines for development and application of IMO goal based standard safety level approach To continue the work from MSC 95, the Committee on this session noted the development of draft Interim Guidelines for developing application IMO goal based standard safety level approach. The Committee endorsed the working group's view on the compelling need for a GBS-SLA example and invited Member States and international organizations to submit concrete GBS-SLA examples to a future session. The Committee also invited Member States and international organizations to submit comments and proposals on the draft Interim Guidelines, with a view towards finalization at a future session. Draft functional requirements of SOLAS Chapter III The development of functional requirement of SOLAS Chapter III has been conducted by SSE 3 and followed by the Correspondence Group on the Development of Functional Requirements for SOLAS chapter III. MSC 96, in general, endorsed the draft and further consideration will be made by MSC 98. D. PASSENGER SHIP SAFETY (AGENDA ITEM 6) Following the loss of the Costa Concordia the IMO undertook a comprehensive review of the accident investigation report and considered what changes to IMO regulation might be needed as a result. In order to conduct review and consideration of above matters, IMO has invited all interested parties to submit any related information or proposal to IMO for consideration by Committee or Sub-Committee. 7 Following the invitation, several Non-Government Organizations submitted their best practice regarding safety on passenger ships, as follows: 1. The application of watermist fire suppression systems in machinery room category A 2. The installation of fixed fire fixed fire extinguishing and detection system for covered mooring deck 3. Best practices for detection and fire suppression on ro-ro passenger ships After the discussion, the Committee agreed to only note these best practices without further action for this session. E. MANDATORY INSTRUMENT AND/OR PROVISIONS ADDRESSING SAFETY STANDARDS FOR THE CARRIAGE OF MORE THAN 12 INDUSTRIAL PERSONNEL ON BOARD VESSELS ENGAGED ON INTERNATIONAL VOYAGES (AGENDA ITEM 7) This issue had been approved by MSC 95 as new planned output and subsequently SDC 3 provided the Committee several viable options to resolve the issue. The issue of mandatory instrument and/or provisions addressing safety standards for the carriage of more than 12 industrial personnel on board vessels engaged on international voyages, hereafter will be referenced as safety for carriage of industrial personnel. General discussions and decision MSC 96 concurred whilst long term solution need to be discussed, which is agreed as the future new Chapter XV of SOLAS and new code addressing the safety for carriage of industrial personnel, the current condition has an urgency to be provided with interim solution. Based on discussion made within the working group, MSC 96 could not agree on the issuance of a Recommendation as interim solution. The Committee noted the complex nature of the legal issue under consideration, thus agreed that this matter should be further considered at the next session MSC 97 whilst requesting further legal advice of the Secretariat on this matter. Roadmap of safety for carriage of industrial personnel MSC 96 noted the draft roadmap provided by the working group and after comprehensive discussion, the Committee decided to further consider the roadmap to MSC 97, in conjunction with the consideration of the draft Recommendation, and the associated draft MSC resolution. As a way forward, MSC 96 instructed SDC 4 on year 2017 to develop draft of new SOLAS Chapter XV, based on outline prepared by working group. While for the new code, the Committee endorsed that it will be: - developed by SDC 4 based on outline prepared by working group in MSC 96; - developed based on 2008 SPS Code and 2000 HSC Code; - developed using goal-based approach; - applicable to ships carrying more than 12 industrial personnel and engaged in international voyages regardless of ship s size, and introducing the number of industrial personnel, tonnage, etc. as limiting parameters inside the code ; and - required partitioning to address the issue of high-speed ships carrying industrial personnel and non-high speed ships carrying industrial personnel. SHIP SYSTEMS AND EQUIPMENT (REPORT OF THE SECOND SESSION AND URGENT MATTERS EMANATING FROM THE THIRD SESSION OF THE SUB-COMMITTEE) (AGENDA ITEM 8) Sub-Committee on Ship Systems and Equipment has completed its third session (SSE 3) on 14 to 18 March As the outcomes of its meeting, SSE 3 has submitted report to MSC 96 to give its approval and consideration on the following draft amendments to mandatory instruments: 1. Draft amendments to SOLAS regulations III/3 and III/ Draft Amendments to SOLAS regulations II-2/1 and II-2/10 3. Approval of amendments to LSA Code 4. Draft MSC resolution on Requirements for maintenance, thorough examination, operational testing, overhaul and repair of lifeboats and rescue boats, launching appliances and release gear, in conjunction with the adoption of the draft associated SOLAS amendments. Furthermore, the Sub-Committee also invited the Committee to approve and consider the following draft of MSC Circulars: 1. Draft MSC circular on Unified interpretations of SOLAS chapter II-2 2. Draft MSC circular on Unified interpretations of chapters 5, 6 and 9 of the FSS Code 3. Draft MSC circular on Unified interpretations of paragraph of the LSA Code, as amended by resolution MSC.320(89) 4. Draft MSC circular on Unified interpretations of SOLAS regulations III/6.4 and III/6.5 and section 7.2 of the LSA Code 5. Draft MSC circular on early implementation of the new chapter 17 of the FSS Code, in conjunction with the adoption of the draft new chapter 17 of the FSS Code 6. Draft MSC circular on Amendments to the recommendation on helicopter landing areas on ro-ro passenger ships (MSC/Circ.895) in conjunction with the adoption of the new chapter 17 of the FSS Code and amendments to chapter 9 of the 2009 MODU Code In general, the Committee approved the report of SSE 3 by instructing the Drafting Group to discuss and consider the draft amendments to mandatory instruments and MSC Circulars provided by SSE 3. In accordance with the report submitted by the Drafting Group, MSC 96 approved draft amendments to mandatory instruments and draft of MSC Circulars. The said amendments will be submitted to MSC 97 for adoption, except for MSC resolution on Requirements for maintenance, thorough examination, operational testing, overhaul and repair of lifeboats and rescue boats, launching appliances and release gear, which is adopted during this session and will be entered into force on 1 January G. IMPLEMENTATION OF IMO INSTRUMENTS (REPORT OF THE SECOND SESSION OF THE SUB- COMMITTEE) (AGENDA ITEM 9) Sub-Committee on Implementation of IMO Instruments has completed its second session (III 2) on 13 to 17 July One of the outcomes submitted to MSC 96 is the insertion of new regulation 2-1 under SOLAS Chapter XI-1 regarding harmonization of survey periods of cargo ships not subject to the ESP Code. 9 After the discussion, the draft amendments to SOLAS regulation XI-1/2-1 were approved by MSC 96 and will be submitted to MSC 97 for adoption. In addition, the following outcomes of III 2 have been discussed and decided by MSC 96: 1. MSC 96 agreed to forward the draft of MSC-MEPC.4 circular on Guidelines for port State control officers on the ISM Code to MEPC 70 and MSC 97 for further consideration with view of adoption. 2. MSC 96 endorse the decision and recommendation taken by III 2 regarding dissemination the Guide for regulating the safety of passenger ships not covered by SOLAS without detail technical review and not to develop the Guide for other type of ships. Furthermore, MSC 96 also noted that III 2 has submitted draft of Assembly resolutions to Assembly 29 th session (A 29). A 29 approved and adopted the following Assembly resolutions: 1. Assembly resolution A.1104(29) on Survey Guidelines Under the Harmonized System of Survey and Certification (HSSC), Assembly resolution A.1105(29) on 2015 Non-exhaustive list of obligations under instruments relevant to the IMO instruments implementation Code (resolution A.1070(28)). H. CARRIAGE OF CARGOES AND CONTAINERS (REPORT OF THE SECOND SESSION OF THE SUB-COMMITTEE) (AGENDA ITEM 10) Following the completion of its second session on 14 to 18 September 2015, Sub-Committee on Carriage of Cargoes (CCC 2) submitted report to MSC 96 in order to obtain consideration and approval on the works done by CCC 2. The important matters emanate from CCC 2 are: 1. Draft amendment to IMDG Code and its related circulars 2. Draft CSC circular on Amendments to the Revised Recommendations on harmonized interpretation and implementation of the International Convention for Safe Containers, 1972, as amended (CSC.1/Circ.138/Rev.1). 3. Draft CSC circular on Amendments to the Guidelines for development of an approved continuous examination programme (ACEP) (CSC.1/Circ.143). 4. Draft CSC circular on List of locations of publicly available ACEP information, with a view to the circular being updated and issued on an annual basis, or when any Administration informs the Organization on changes to their ACEP information. 5. Draft CSC circular on Instructions for use and information concerning the Global ACEP Database. 6. Draft MSC circular on Due diligence checklist in identifying providers of CTU-related services. 7. Draft amendments to paragraph of the IGC Code, as amended by resolution MSC.370(93), with a view to subsequent adoption, taking into account the check/monitoring sheet and records for regulatory development prepared by the Secretariat 8. MSC circular on early implementation, taking into account the potential for industry to be unable to meet the current requirement of the IGC Code, as amended by resolution MSC.370(93), for A-0 fire-rated wheelhouse windows. As the results of the discussion made in plenary, MSC 96 approved to report of CCC 2 in general. Attachment of Technical Information No: Page 9 of 15

SHIP DESIGN AND CONSTRUCTION (REPORT OF THE THIRD SESSION OF THE SUB-COMITTE) (AGENDA ITEM 11) Amandments of SOLAS Chapter II-1 Since MSC 95, the draft amandments of SOLAS Chapter II-1 related to subdivision and stability of passenger ships was approved in principal, and a number of improvement continued to be made by SDC 3. MSC 96 approved the amandments of SOLAS chapter II-1 with a view to subsequent adoption at MSC 97. Meanwhile specifically concerning the amandments of passenger ship safety index (R-index) formula, Japan expressed their concern on the suitability of R-index formula for passenger ships carrying less than 2000 passengers. The amandments of SOLAS Chapter II-1 is expected to enter into force on 1 January 2020 Amandemen SPS Code In line with the discussion of the amandement of SOLAS chapter II-1 by SDC 3, the discussion related to the application of the requirements for special purpose ships was conducted. MSC 96 approved the amandments of SPS code related to the revision of R-index formula for the special purpose ship to apply the same formula with passenger ship, where the ship is considered as passenger ship and special personnel on board are considered as passengers. Amandments to the introduction and part B of the International Code on Intact stability, 2008 (2008 IS code) MSC 95 already approved the draft amandments of 2008 IS code related to ships with anchor handling operations, and including escort towing tug as well as lifting operations. In this session, MSC 96 approved the amandments of the introduction and part B of 2008 IS Code, with a view to subsequent adoption at MSC 97. Draft MSC Circular on Revised Guidelines on operational information for master of passenger ships for safe return to port SDC 3 discussed the uniform implementation of SOLAS regulation II-1/8-1.3 by considering the draft of Revised guidelines on operational information for masters of passenger ship for safe return to port. MSC 96 approved the MSC.1/Circ.1532 on Revised guidelines on operational information for masters of passenger ships for safe return to port. Draft MSC Circular on Revised guidelines on evacuation analysis for new and existing passenger ships Development of guidelines on evacuation analysis for new and existing passenger ships has been started on MSC 71 and it is intended to be applicable for passenger ship and high speed craft. MSC 75 approved the interim guidelines on evacuation anaysis for new and existing passenger ships, and invited all Members States for exchanging data information regarding research, further development of interim guidelines. MSC 83 approved Guidelines on evacuation analysis for new and existing passenger ships as well as ro-ro passenger ships. Subsequently, MSC 96 approved MSC.1/Circ.1533 on Revised guidelines on Attachment of Technical Information No: Page 10 of 15

11 evacuation analysis for new and existing passenger ship as the guidance for implementation of amandments SOLAS regulation II-1/ With this approval the evacuation analysis becomes mandatory requirement for ro-ro passenger ship as well as new passenger ship other than ro-ro passenger ship in which carrying more than 36 passengers where the construction date is on or after 1 January Amandements to FSS code chapter 13 paragraph MSC 96 approved the amandments of FSS Code chapter 13 paragraph related to distribution of crew at the public space, with a view to subsequent adoption at MSC 97. Amandments to 2011 ESP Code MSC 95 approved amandments to 2011 ESP code, related to: The thickness measurement on the required structural elements should be conducted during close-up survey The requirement to conduct close-up survey and thickness measurement on the stiffener and plate of hatch cover and coaming MSC 96 approved the amandments of 2011 ESP code with a view to subsequent adoption by MSC 97. Draft MSC Circular Early Implementation of the acceptance of the use butterfly valves on Cargo ship MSC 96 approved in principle the amandments of SOLAS Chapter II-1 on the regulation of subdivision and damage stability in related and concerned to the application of a butterfly valve in the pipe(s) piercing the collision bulkhead in cargo ship. Amandments of SOLAS chapter II-1 will be entered into force on 1 January 2020; therefore the early implementation of this amendment is needed. MSC 96 approved,in principle, the draft MSC circular on early implementation for acceptance of the use of butterfly valves on Cargo ships while requesting the Secretariat to prepare the related MSC circular for consideration by MSC 97. J. POLLUTION PREVENTION AND RESPONSE (REPORT OF THE THIRD SESSION OF THE SUB COMITTE) (AGENDA ITEM 13) Referring to IBC code paragraph regarding the protection of cargoes from deleterious chemical change due to contact with others at all times during the voyage, PPR 3 has developed certification of protection for products requiring oxygen-dependent inhibitor as required by IBC code paragraph In this session, the draft MSC-MEPC circular on example of a certificate of protection for products requiring oxygen-dependent inhibitors was forwarded for approval by MSC 96 and MEPC 70. MSC 96 approved the MSC-MEPC circular on example of a certificate of protection for products requiring oxygen-dependent inhibitors, the formal release is pending for approval by MEPC 70. K. IMPLEMENTATION OF INSTRUMENTS AND RELATED MATTERS (AGENDA ITEM 20) Attachment of Technical Information No: Page 11 of 15

12 The implementation of Noise Code have been forced on 1 July 2016 by resolution MSC.337(91) and become mandatory for ships of 1,600 GT and above which are built on or after 1 July 2018 by resolution MSC.338(91) regarding the amendments to SOLAS regulation II-1/3-12. Having noted the implementation of Noise Code, several IMO member states have experience difficulty to implement the provision of the Code for ships with following conditions: 1. for which the building contract is placed before 1 July 2014; and 2. the keels of which are laid or which are at a similar stage of construction on or after 1 January 2015; and 3. the delivery of which is before 1 July 2018 In order to accommodate the above issues, MSC 96 agreed to amendment SOLAS regulation II-1/3-12 to clarify the application of Noise Code for ships with above conditions and requested the Drafting Group to prepare draft amendments to SOLAS and MSC Circular as interim solution for applying the relevant provisions of SOLAS regulation II-1/3-12 for the aforementioned ships. Draft amendments to SOLAS regulation II-1/3-12 will be submitted to MSC 97 with view to adoption. L. LIST OF MSC RESOLUTIONS FROM MSC Resolution MSC.402(96) Requirements for maintenance, thorough examination, operational testing, overhaul and repair of lifeboats and rescue boats, launching appliances and release gear 2. Resolution MSC.403(96) Amendments to the International Code for Fire Safety Systems (FSS Code) 3. CONSIDERATION AND ADOPTION OF AMENDMENTS TO MANDATORY INSTRUMENTS (AGENDA NOMOR 3) Maritime Safety Committee dalam sesinya yang ke-95 (MSC 95) telah melakukan pembahasan dan menyetujui draf amandemen dari instrumen wajib sebagai berikut: 1. SOLAS Chapter II-2 2. The International Code on the Enhanced Programme of Inspections during Surveys of Bulk Carriers and Oil Tankers (ESP Code) The International Code for Fire Safety Systems (FSS Code) 4. The International Convention on Standards of Training, Certification and Watchkeeping for Seafarers (STCW) The Seafarers' Training, Certification and Watchkeeping (STCW) Code 6. Code for the Construction And Equipment of Mobile Offshore Drilling Units 2009 (MODU Code 2009) 7. The International Maritime Dangerous Goods (IMDG) Code 8. The International Code on Intact Stability, 2008 (IS Code 2008) Menindaklanjuti keputusan dari MSC 95, Komite membentuk Drafting Group pada MSC 96 untuk melakukan finalisasi agar dapat diadopsi pada sesi ini. Berdasarkan hasil diskusi dari Drafting Group, MSC 96 menyetujui draf yang telah disiapkan dan mengadopsi amandemen dari instrumen wajib tersebut. Amandemen dari instrumen wajib tersebut akan secara efektif berlaku pada 1 Januari Akan tetapi, untuk amandemen terhadap ESP Code, IMDG Code, STCW Convention dan STCW Code akan berlaku pada 1 Januari Sebagai tambahan, Komite juga telah mengadopsi MSC Circular untuk mendukung amandemen terhadap IMDG Code, yaitu: 1. MSC/Circ.1025 (Revised Emergency Response Procedures for Ships Carrying Dangerous Goods (EmS Guide)) 2. MSC.1/Circ.1442 (Inspection programmes for cargo transport units carrying dangerous goods) B. MEASURES TO ENHANCE MARITIME SECURITY (AGENDA NOMOR 4) Keamanan Dunia Maya Maritim (Maritime Cybersecurity) MSC 94 telah membahas isu keamanan dunia maya maritim dan pentingnya bagi kapal melakukan antisipasi terhadap ancaman yang berasal dari dunia maya. Menindaklanjuti diskusi yang ada pada MSC 95, Komite menegaskan bahwa isu keamanan di dunia maya sebagai isu yang penting. Oleh karenanya MSC 95 meminta kepada Negara Anggota IMO, organisasi internasional, dan industri untuk bekerjasama dalam mengembangkan guidelines terkait keamanan di dunia maya bagi kapal, dengan jadwal untuk memberikan draf guidelines tersebut pada sidang FAL 40 dan MSC 96. Pada MSC 96, industri yang diwakili oleh ICS, IUMI, BIMCO, INTERTANKO, CLIA dan INTERCARGO menyerahkan Guidelines on cybersecurity on board ships yang dipublikasikan pada Januari 2016 dengan versi 1.1 sebagai pembaruan. Guidelines ini spesifik untuk penerapan diatas kapal dan Lampiran dari Informasi No: Halaman 3 dari 15

19 ditujukan sebagai bantuan bagi pemilik kapal dalam mempersiapkan prosedur dan rencana aksi terkait keamanan dunia maya, dengan pendekatan pengkajian resiko. Teks lengkap dari Guidelines dapat diunduh pada tautan Beberapa Negara Anggota IMO pada sesi MSC ini memasukkan usulannya terkait keamanan dunia maya maritim dan langkah-langkah untuk meningkatkan kesiapan terhadap penanganan ancaman dunia maya diatas kapal. Setelah melalui diskusi pada working group, maka Guidelines for Cyber risk Management yang diserahkan oleh Kanada, Jepang, Liberia, Marshall Islands, Norwegia dan Amerika Serikat dipergunakan sebagai basis pengembangan dokumen. MSC 96 pada akhirnya menyetujui Interim guidelines on maritime cyber risk management sebagai MSC.1/Circ Guidance untuk pengembangan legislasi nasional terkait keamanan maritim Sejak implementasi ISPS Code tanggal 1 Juli 2004, terdapat beberapa tantangan dalam penerapannya, antara lain diperlukan adanya legislasi nasional yang komprehensif. IMO mempublikasikan Guide to Maritime Security and the ISPS Code (GMSIC) pada tahun 2012 sebagai usaha membantu para pemangku kepentingan keamanan maritim. Guide ini juga menekankan pentingnya untuk menspesifikasikan kewenangan yang perlu diberikan kepada petugas Pemerintah dalam menjalankan tugasnya, termasuk pemeriksaan dan pengujian dari langkah dan prosedur keamanan di pelabuhan, fasilitas pelabuhan, dan diatas kapal, dan penerapan penegakan peraturan jika terjadi insiden pelanggaran. MSC 96 menyetujui Guidance for the development of national maritime security legislation sebagai MSC.1/Circ.1525, dimana Guidance tersebut selain membedakan mana saja yang menjadi persyaratan wajib dan mana saja yang bersifat rekomendasi, juga menekankan sifat dari Guidance secara keseluruhan yang berupa rekomendasi bukan kewajiban. MSC 96 mengundang Negara Anggota IMO yang ingin menggunakan Guidance tersebut dalam pengembangan legislasi nasional keamanan maritimnya, dan untuk menyampaikan kepada IMO jika memerlukan bantuan teknis dalam implementasinya. C. GOAL BASED NEW SHIPS CONSTRUCTION STANDARD (AGENDA ITEM 5) Laporan verfikasi audit GBS SOLAS regulasi II-1/3-10 sebagaimana telah diamandemen oleh resolusi MSC 290(87) mempersyaratkan kapal tangki minyak dan kapal pengangkut muatan curah yang memiliki kontrak pembangunan pada atau setelah 1 Juli 2016, atau tidak adanya kontrak bangunan, peletakan lunas atau yang pada tahap pembangunan yang serupa pada atau setelah 1 Juli 2017, atau diserah terimakan pada atau setelah 1 Juli 2020 untuk dirancang dan dibangun sesuai dengan GBS. Peraturan tersebut menetapkan aturan/rules untuk konstruksi harus diverifikasi oleh IMO sesuai dengan Guidelines for verification sebagaimana tertuang dalam MSC Resolusi 296(87).. Hingga saat ini, 12 organisasi yang diakui (Recognized Organization/RO) telah diaudit dan dilaporkan ke MSC 96, dengan rangkuman sebagai berikut: 1. Dari 13 RO yang memasukkan aplikasi, salah satu RO membatalkan proses audit verifikasi awal. Lampiran dari Informasi No: Halaman 4 dari 15

20 2. Temuan dari audit mengungkapkan 6 ketidaksesuaian dan 88 observasi. 3. Dua belas RO tersebut sudah mengajukan rencana perbaikan mereka yang akan dimulai pada 1 Juni 2016, dan selanjutnya akan tercermin dengan melakukan amandemen terhadap aturan/rules mereka pada Desember 2016 dan diharapkan mulai berlaku pada 1 Juli MSC 96 menyetujui rencana perbaikan dan menegaskan bahwa semua aturan konstruksi dari 12 RO telah sesuai dengan standar konstruksi IMO goal based untuk kapal pengangkut muatan curah dan kapal tangki minyak. Dalam rangka memberikan pedoman praktis terkait dengan pelaksanaan SCF di darat atau kapal dan akses transparansi data oleh pemilik kapal, badan klasifikasi dan administrator negara Bendera agar dapat dilakukan, maka dikembangkan standar industri untuk SCF. Isu penting dari standar industri SCF adalah sebagai berikut: 1. Sifat Intelectual (IP) yang tepat seperti yang dijelaskan dalam SCF data dan dokumen: a. Level IP tinggi b. Level IP biasa c. Level IP ini adalah proses dengan mempertimbangkan persetujuan dari pemilik kapal dan pemegang IP (umumnya, desainer kapal atau galangan kapal). 2. Pengembangan arsip pusat di darat dilakukan dalam rangka untuk menyimpan dokumen dan data SCF dalam format digital. Pusat Arsip adalah pusat seluruh data SCF / dokumen (kapal onboard dan / atau onshore) disimpan. Pekerjaan lanjutan terkait Interim Guidelines for development and application of IMO goal based standard safety level approach Untuk melanjutkan pekerjaan dari MSC 95, Komite pada sesi ini mencatat perkembangan rancangan Interim Guidelines for developing application IMO goal based standard safety level approach. Komite mendukung pandangan working group pada kebutuhan yang mendesak untuk contoh dari GBS-SLA dan mengundang negara anggota dan organisasi-organisasi internasional untuk mengirimkan contoh nyata aplikasi GBS-SLA di sesi mendatang. Komite juga mengundang negara anggota dan organisasi-organisasi internasional untuk mengirimkan komentar dan usulan untuk draft Interim Guidelines, dengan pandangan untuk dapat difinalisasi di sesi mendatang. Draf persyaratan fungsional dari SOLAS Chapter III Perkembangan dari functional requirement SOLAS Chapter III telah dilakukan oleh SSE 3 dan diikuti oleh Correspondence Group untuk Development of Functional Requirements for SOLAS chapter III. Secara umum, MSC 96 mendukung draf tersebut dan pertimbangan lebih lanjut akan dilakukan di MSC 98. D. PASSENGER SHIP SAFETY (AGENDA NOMOR 6) Menindaklanjuti kecelakaan kapal Costa Concordia, IMO telah melakukan review yang komprehensif terhadap laporan investigasi kecelakaan tersebut dan mempertimbangkan untuk melakukan perubahan Lampiran dari Informasi No: Halaman 6 dari 15

22 pada aturan IMO untuk mencegah kecelakaan yang sama terjadi kembali. Untuk melakukan review dan pertimbangan tersebut, IMO mengundang semua pihak untuk memasukkan informasi atau usulan kepada IMO untuk dipertimbangkan oleh Komite maupun Sub- Komite IMO. Sehubungan dengan hal tersebut, beberapa best practice telah dimasukkan oleh beberapa lembaga NGO kepada IMO untuk dibahas pada sesi ini, yaitu: 1. Penggunaan watermist fire suppression systems pada ruang permesinan kategori A 2. Penggunaan fixed fire extinguishing and detection system pada covered mooring deck 3. Metode untuk melakukan pendeteksian dan pemadaman kebakaran pada kapal ro-ro passenger Setelah diskusi panjang, Komite memutuskan untuk menerima best practice tersebut sebagai informasi dan memutuskan bahwa pembahasan lebih lanjut untuk agenda ini belum diperlukan. E. MANDATORY INSTRUMENT AND/OR PROVISIONS ADDRESSING SAFETY STANDARDS FOR THE CARRIAGE OF MORE THAN 12 INDUSTRIAL PERSONNEL ON BOARD VESSELS ENGAGED ON INTERNATIONAL VOYAGES (AGENDA NOMOR 7) Isu ini telah disetujui oleh MSC 95 sebagai new planned output dan dilanjutkan oleh SDC 3 dengan mengajukan beberapa opsi potensial sebagai penyelesaiannya. Isu terkait mandatory instrument and/or provisions addressing safety standards for the carriage of more than 12 industrial personnel on board vessels engaged on international voyages, selanjutnya disingkat sebagai safety for carriage of industrial personnel. Diskusi dan keputusan umum MSC 96 menyepakati meskipun solusi jangka panjang perlu didiskusikan, yang mana disepakati adanya Chapter XV sebagai chapter baru SOLAS dan adanya code baru terkait safety for carriage of industrial personnel, terdapat urgensi untuk memberikan solusi bagi situasi legislasi yang terjadi saat ini. Berdasarkan diskusi yang terdapat di dalam working group, MSC 96 tidak dapat menemukan kesepakatan untuk menerbitkan Rekomendasi sebagai solusi interim. Komite menyadari kompleksitas hokum isu tersebut, dan memutuskan bahwa permasalahan ini untuk dilanjutkan pembahasannya pada MSC 97 seraya meminta nasehat hokum dari Sekretariat IMO terkait hal ini. Peta jalan terkait safety for carriage of industrial personnel MSC 96 mencatat draf peta jalan sebagaimana disiapkan oleh working group dan setelah diskusi yang mendalam, menyepakati bahwa peta jalan tersebut untuk dibahas pada MSC 97, bersamaan dengan pembahasan draf Rekomendasi dan draf resolusi MSC terkait. Sebagai langkah ke depannya, MSC 96 menginstruksikan kepada Sub-Komite SDC 4, yang akan bersidang tahun 2017, untuk mengembangkan draf chapter baru SOLAS Chapter XV dengan kerangka yang disiapkan oleh working group.
