Jalanan menuju tempat itu, dan tempat itu sendiri, adalah semacam ironi dari gegasnya pertumbuhan ibu kota. Kiri kanan adalah bangunan-bangunan separo rusak, separo tak berpenghuni, sampah yang berserakan, serta aroma busuk bakteri anaerob dari kali yang hanya mengalir air berwarna hitam. Kemiskinan seperti tidak bisa diusir dari sana. Di tempat yang bahkan sopir taksi pun tak mengenali jalanannya itu, ribuan orang menggantungkan hidup dari penghasilan yang serba tak pasti Air adalah satu dari sekian enjaringan is one of poorest areas in Jakarta. Bapak dengan empat orang anak ini telah lebih dari sepuluh tahun membangun keluarga di Jakarta. Mulanya ia bekerja di pabrik konveksi, sebelum PHK membuatnya menjadi pengangguran. Ia kini mencari nafkah dengan bekerja serabutan, termasuk menjadi hansip di kelurahan. Pengakuan Endang bukannya mengada-ada. Karena tempat itu berdekatan dengan laut, air sumur tidak bisa diharapkan untuk minum. Untuk mencuci pun, air terlalu keruh. Maka, untuk mendapatkan air b e r s i h, p e n d u d u k d i t e m p a t i t u menggunakan berbagai macam cara. Sebagian besar seperti yang dilakukan Endang, membeli air per gerobak setiap hari, yang lain berlangganan air perpipaan atau biasa disebut air ledeng perusahaan swasta PAM Lyonnaise Jaya (Palyja). Dan beberapa lainnya masih terpaksa menggunakan sumur. Semua cara itu tidak ada yang mudah. Setiap hari orang-orang masih harus merasa kesulitan mendapatkan air bersih. W a r g a y a n g c u k u p m a m p u berlangganan sambungan pipa Palyja pun tak menjadi lebih mudah mendapat air. Seorang ibu rumah tangga, Yiyin, mengaku air hanya mengalir antara jam dua hingga jam tiga malam. Alirannya pun sangat kecil. Dalam satu malam ia hanya bisa mendapat dua ember air bersih. Itu pun tiga hari sekali. Memang cukup menimbulkan pertanyaan layanan oleh perusahaan swasta kaliber internasional yang telah berlangsung sejak lebih dari sepuluh tahun lalu masih menghadapi persoalan seperti gagalnya mengalirkan air pipa setiap hari. Padahal awal masuknya perusahaan swasta ini salah satunya untuk mengatasi masalah semacam itu. Bahkan perusahaan swasta yang diundang pun ada dua, dengan pembelahan Jakarta dibatasi Ciliwung untuk membagi wilayah layanan. Bagian timur Jakarta digarap oleh PAM Lyonnaise Jaya (PALYJA), sementara bagian barat Jakarta digarap oleh PT Thames PAM Jaya, kini PT AETRA Air Jakarta. People that are able to afford pipedwater from Palyja are no easier to get water, though. A mother, Yiyin, testified that water in her piped-water connection only run from 2.00 up to 3.00 in the morning. The worse, the stream flow is often very low. In one day, she can only get 2 buckets of water. It's one time in three days. It raises question indeed, the service of international level private water company began more than a decade ago still face problems like failing to provide piped-water everyday. Besides, one of reasons to involve private companies was to solve such problem. Jakarta even needed to involve two private companies, 2

3 PAM Jaya, sebuah perusahaan air minum yang dimiliki oleh Pemerintah DKI Jakarta, menjalin kerja sama dengan dua operator swasta yaitu PT Thames Pam Jaya (TPJ) dan PT Pam Lyonnaise Jaya (Palyja). Sebagian besar saham Palyja dimiliki oleh Suez Environnment dari Prancis, sementara TPJ semula dimiliki oleh Thames Water dari Inggris dan sejak awal 2007 telah berpindah tangan ke Acuatico. Dua perusahaan swasta ini masing-masing memperoleh hak tunggal untuk menyediakan layanan air minum bagi seluruh penduduk Jakarta. Sebagaimana yang diungkapkan oleh Syamsu Romli, yang saat itu menjabat sebagai direktur PAM Jaya, setahun sebelum kerja sama dengan dua mitra swasta mulai berlaku. Kala itu Romli juga sempat menjanjikan bahwa kerja sama dengan mitra swasta tidak akan membuat masyarakat terbebani tarif air yang tinggi. Tetapi hingga saat ini ada bagianbagian dari Jakarta, seperti Penjaringan, yang menjadi saksi bagaimana janji-janji manis lebih dari sepuluh tahun silam itu tidak pernah menjadi nyata. Bagi masyarakat miskin tersebut, air tetap sulit untuk dicari. Air tetap amat mahal untuk dijangkau. Tidak didesain untuk masyarakat miskin Dua isu yang selalu muncul dalam layanan air di Jakarta adalah kebocoran dan perluasan jaringan perpipaan. Niat untuk mengatasi dua persoalan itulah juga menjadi salah satu alasan bagi pemerintah untuk menjalin kerja sama dengan dua mitra swasta, karena PAM Jaya merasa tak memiliki cukup modal. Akan tetapi sejak kontrak konsesi 25 tahun dengan pihak swasta yang dimulai pada 1997, hingga kini kinerja layanan air di with dividing the city into two areas of the company's service coverage using Ciliwung River as border. Pada target teknis, paling mencolok Palyja gagal memenuhi target rasio cakupan pelayanan. Dari 75% target, hanya 58.99% yang terpenuhi. Sementara dari segi target layanan, realisasi yang kegagalannya paling parah adalah pelayanan sambungan baru, yaitu d a r i % d e n g a n h a n y a terpenuhi 32,96%. Dalam evaluasi kinerja p a s c a - R C A ( R e s t a t e d C o o p e r a t i o n Agreement) Badan Regulator PAM Jaya lebih jauh menyebutkan tentang buruknya kinerja dua operator swasta. Dalam hal menjangkau pelanggan baru, Palyja hanya mampu mencapai target hingga Tahun-tahun setelah itu Palyja berturut-turut gagal, dan kembali mencapai target pada 2007 dan Sementara TPJ, target terpenuhi sampai Tahun-tahun setelah itu TPJ terus mengalami kegagalan memenuhi target. Dalam hal kapasitas produksi, dua operator swasta memang terlihat melampaui target. Selama 2008, kapasitas produksi air Jakarta mencapai 430,2 juta m3/tahun, melebihi target 405,0 m3/tahun. Akan tetapi, meskipun angka kapasitas produksi meningkat, di sisi lain tingkat kebocoran tak mengalami perbaikan. Dengan kata lain, t e r d a p a t k e l e b i h a n p r o d u k s i d a n pengelolaan yang tidak efisien, yang pada akhirnya pelanggan harus menderita kerugian. Rasio keterjangkauan layanan, yang dilaporkan terus mengalami peningkatan oleh operator swasta, ditengarai oleh BR PAM Jaya mengalami pembengkakan karena indikator yang dipakai sebagai kalkulasi jauh d a r i k e n y a t a a n. However, even though the number of production capacity was increasing, the decrease of leakage level was not improved. In other word, there were over production and inefficient management, which at the end it inflicted a loss upon customers. Service coverage ratio, which was reported experiencing improvements by private operators, was identified by the Regulatory Body swelling as the indicators used for calculations were far from the actual condition.

Kinerja yang buruk juga terlihat dari volume air terjual yang gagal memenuhi target. Total volume air terjual selama 2008 adalah 257,95 juta m3 (Palyja 134,509 juta m3, and TPJ 123,44 juta m3) yang masih berada di bawah target dalam finpro (proyeksi keuangan) yang totalnya 287,84 juta m3 (Palyja 134,31 juta m3, TPJ 153,52 juta m3). Meskipun rasio maksimum tercapai pada akhir 2007, tapi pencapaiannya masih berada jauh di bawah target dalam proyeksi keuangan. Pencapaian volume air terjual hanya 85,32% (Palyja 88.67%, dan TPJ 82.10%). Di tengah kinerja yang tak memuaskan itulah tarif air justru terus mengalami kenaikan. Sejak awal konsesi, pada 1997, tarif rata-rata di Jakarta sudah mencapai Rp per meter kubik. Sebagai perbandingan, PDAM Kota Semarang hingga 2008 tarif airnya Rp per meter kubik. Tarif tersebut kemudian terus mengalami kenaikan karena inflasi, dan kenaikan tarif otomatis setiap 6 bulan, yang diatur dengan SK Gubernur DKI Jakarta dan ketetapan DPRD DKI Jakarta. PTO ini berlaku dari 2004 hingga Tercatat sejak konsesi dimulai, telah terjadi kenaikan tarif sebanyak sepuluh kali, Empat diantaranya terjadi di masa PTO. Sebetulnya swasta menginginkan PTO II segera disetujui, akan tetapi sampai saat ini proses pembahasannya masih terus berlangsung. Salah satu penyebab PTO II sulit disetujui adalah karena performace swasta yang memang masih banyak di bawah target. Even though the maximum ratio reached by the end of 2007, the achievement was still below the finpro target. Volume water sold was only 85.32% (Palyja 88.67% and TPJ 82.10%). In the situation of these bad performances, the tariff has been increasing from time to time. From the beginning of the concession, in 1997, tariff average in Jakarta had reached Rp per cubic meters. As comparison, PDAM of Semarang city up to 2008 the tariff was only Rp per cubic meters. It then experienced increases due to inflation, and automatic tariff adjustment each 6 months, which was regulated by the 5

6 Water charge dan water tariff Satu hal penting yang membedakan konsesi ini dengan privatisasi di kota-kota lain di dunia adalah pada adanya mekanisme yang memisahkan antara pendapatan dari pelanggan layanan air yang biasa disebut dengan tarif air dengan imbalan (water charge) yang diterima operator pelaksana layanan. Tarif air adalah harga yang dibebankan pada pelanggan, yang merupakan sumber pemasukan PAM Jaya. Sedangkan imbalan air adalah harga yang harus dibayar PAM Jaya pada Palyja. Dari waktu ke waktu, kenaikan tarif dipicu oleh naiknya imbalan air yang dituntut oleh swasta ke PAM Jaya. P A M J a y a s e n d i r i, u n t u k menghindari kenaikan tarif yang membebani pelanggan, sulit melakukan negosiasi dengan swasta mengenai harga imbalan air. Pasalnya, kontrak konsesi menempatkan proyeksi keuangan sebagai faktor paling menentukan dalam menetapkan water charge. Sementara proyeksi keuangan yang dimaksud, sebagaimana disebutkan dalam kontrak kerja sama, lebih banyak menitikeberatkan pada kebutuhan finansial pihak swasta Dalam rebasing, penentuan imbalan air sama sekali tak berdasarkan performance-based (kinerja). Dapat dikatakan berapapun kebutuhan uang yang diminta swasta dalam bentuk imbalan air, PAM Jaya terpaksa memenuhinya. Kondisi ini tentu saja menyulitkan PAM Jaya. Di satu sisi perusahaan milik pemerintah daerah ini terikat kontrak untuk membayar imbalan air sesuai permintaan mitra swasta, yang semakin hari terus naik, di satu sisi PAM juga tidak bisa begitu saja menaikkan tarif yang dibebankan pada pelanggan. Sejak dimulainya kontrak konsesi, water tariff hampir selalu berada di bawah water charge. Selisihnya atau biasa disebut shortfall ditanggung PAM Jaya dalam bentuk hutang pada swasta. Jumlah shortfall terakhir menurut Laporan Keuangan Palyja per 30 Juni 2009 adalah Rp 224 miliar dan Rp 250 miliar untuk PT Aetra berdasar Laporan Keuangan 30 Desember Jumlah selisih tersebut memang tidak main-main. Water charge and water tariff An important point that differentiates this concession with the other concessions in cities in the world is on the mechanism that using disparity between incomes from customers, called water tariff, with the water charge which is received by the operators. Water tariff is a price borne by the customers; it is the income for PAM Jaya. While water charge is a price that has to be paid by PAM Jaya to Palyja. From time to time, tariff increasing has been triggered by the increase of water charge proposed by the parties to PAM Jaya. PAM Jaya itself, to prevent the tariff increasing that burden the customers, is in difficulties to renegotiate with the parties related with the water charge price. It is because the concession contract put the financial projection as the most dominant factor in determining the water charge. While the financial projection, as mentioned in the cooperation agreement, emphasizes the parties' financial need. On the rebasing, determination of water charge is totally not by performancebased. In other word, no matter how high the financial need proposed by the parties, PAM Jaya is forced to approve it. This condition puts PAM Jaya in a difficult situation, indeed. In one side, this government-owned company is bounded by the contract to pay the water charge according to the parties' proposal, which is increasing from day to day, in other side PAM Jaya is also unable to increase the tariff to customers. Since the beginning of the concession, the water tariff has always been below the water charge. The gap, or usually called shortfall, is borne by PAM Jaya in the form of debt to the parties. The last total of shortfall according to Palyja's financial 6

7 mengacu klaim Palyja di situs resmi mereka bahwa 12% p e l a n g g a n n y a a d a l a h masyarakat miskin, maka tarif yang digunakan adalah tarif untuk kelompok II (rumah tangga sangat sederhana dan sejenisnya) yang pada bulan Desember 2009 adalah Rp per meter kubik. Sementara imbalan air yang berlaku pada periode yang sama sebesar Rp per meter kubik. Maka selisih sejumlah Rp per m e t e r k u b i k m e n j a d i tanggungan PAM Jaya dan dihitung sebagai hutang ke Palyja. Begitu juga yang terjadi dengan Aetra. Dengan defisit yang terus menerus terjadi, maka nilai hutang PAM Jaya kepada swasta pun makin hari makin menumpuk. Pola ini jelas tidak mendorong swasta untuk mengembangkan layanan kepada masyarakat miskin. Penyebab utamanya tentu saja adalah gap yang besar antara tarif yang dibebankan untuk masyarakat miskin dengan water charge. Hutang PAM Jaya pada swasta menjadi semakin besar dan membuat siapapun meragukan kemampuan PAM Jaya untuk melunasinya. Dengan menambah layanan pada masyarakat maka secara langsung akan menambah shorfall PAM Jaya. Suatu hal yang sebetulnya merugikan baik bagi swasta maupun PAM Jaya. Hal ini tentu saja mendorong swasta untuk lebih memilih berkonsentrasi dengan golongan pembayar tarif tinggi karena pembayaran tarifnya setara atau melebihi nilai water charge yang ditetapkan sehingga lebih mampu menjamin kelancaran cash flow perusahaan dan tentu saja peningkatan keuntungan. Untuk meningkatkan layanan pada masyarakat miskin sebetulnya sudah dilakukan beberapa upaya di antaranya dengan hibah dari Bank Dunia melalui program Global Partnership-on Output Based Aid (GPOBA). Program ini memungkinkan warga untuk mendapatkan pelayanan air PAM dengan harga murah. Sambungan biaya baru Rohana (31), seorang ibu rumah tangga yang sedang mencuci di sebuah MCK di Penjaringan, Jakarta Utara, mengaku biaya untuk membeli air memakan hampir 70% penghasilan suaminya. statement per June 30 was Rp. 224 billion and Rp. 250 billion for PT Aetra based on The December financial statement. This pattern definitely does not encourage the parties to expand their service to the poor. The main cause is the large gap between water tariff for the poor with the water charge. PAM Jaya's debt to the parties will be getting bigger and make anyone doubt PAM Jaya's ability to pay it. By expanding services to the public, it will indirectly increase PAM Jaya's shortfall. Something which is actually inflicting loss upon both PAM Jaya and the parties. This situation encourages the parties to choose concentrating with the consumers from high tariff group because the tariff payment is 7

8 hanya Rp , lebih murah dari biaya normal untuk kelompok rumah tangga sangat sederhana (II) yang sebesar Rp atau kelompok rumah tangga menengah (III) yang sebesar Rp Jika sambungan telah dibuat dan berhasil dijalankan dengan standar yang disepakati dan dapat dibuktikan dalam kurun waktu tertentu air terbukti mengalir di tempat tersebut, Bank Dunia akan mengganti biaya investasi yang sudah lebih dahulu dikeluarkan oleh swasta. Tetapi program ini menyisakan ganjalan di pihak swasta karena Bank Dunia hanya mengganti biaya sambungan. Padahal layanannya diperuntukkan bagi masyarakat miskin yang berarti tarifnya jauh lebih rendah dibanding water charge yang ditetapkan swasta. Tentu saja ini akan kembali mendorong swasta untuk mengalihkan layanan ke kelompok pelanggan yang memiliki tingkat ekonomi lebih baik. Lain ceritanya jika WB bersedia untuk juga meng-cover selisih tarif. Apabila ini dilakukan bisa dipastikan air akan mengalir lancar di pemukiman-pemukiman kumuh di Jakarta. Bagi swasta sendiri proyek GPOBA ini jelas menguntungkan karena dapat meningkatkan rasio cakupan layanan mereka dengan tanpa mengeluarkan biaya karena biaya yang digunakan adalah dana hibah dari WB. Mengenai aliran air sepanjang nilai tarifnya masih jauh di bawah water charge tentu saja tidak ada yang bisa memaksa swasta mengalirkan air secara lancar ke daerah-daerah tersebut. Dengan kata lain, program ini sebenarnya tak mengatasi masalah lama, yaitu lemahnya motivasi swasta untuk memberi pelayanan pada masyarakat miskin.[] equal or exceed the water charge determined so it will be more able to ensure a smooth company's cash flow and of course the increase of profit. This situation again will encourage the parties to divert their service to the higher income customer. It will be different if WB is willing to cover the tariff gap. If this is realized, it can be guaranteed the water run smoothly to slum areas in Jakarta. For the private parties, GPOBA project is definitely profitable because it can increase their coverage ratio and they do not need to spend costs because it has been covered by WB's grants. In terms of water coverage, as long as the tariff is far below the water charge, nothing can force the private parties to run water smoothly to the areas.
