BRIEF INFORMATION OF IMO SUBCOMMITTEE ON IMPLEMENTATION OF IMO INSTRUMENTS SESSION 2 (III 2) NONMANDATORY INSTRUMENTS ON REGULATIONS FOR NONCONVENTION SHIPS (AGENDA ITEM 3) In promoting and enhancing maritime safety aspects relating to nonconvention vessels, including small fishing vessels and domestic passenger ferries, a modular set of standards and harmonized regulations and model national legislation for ships not covered by the 1974 SOLAS Convention (hereinafter called GlobalReg ) were developed through consultancy, as well as a basic model course in the framework of technical cooperation. Following the discussions of related matters made during the Committee and SubCommittee Meetings, it was agreed that at initial stage, nonmandatory instrument on safety standards for nonconvention ships should be limited to the common general regulations and to the specific regulations applicable to "non convention" passenger ships. Furthermore, it was also agreed that GlobalReg is not intended to undermine existing regional, bilateral and national standards. The work on GlobalReg was undertaken on the basis of the twotier system. During III 2, the Sub Committee has reviewed and endorsed the nonvalidated the Guide for regulating the safety of passenger ships not covered by SOLAS: generic principles and functional requirements for devising national or regional regulations for passenger ship safety certification as the completion of tier I. In addition, III 2 agreed that the draft guide should rather be circulated as an annex to the III 2 Meeting Report. The guide will be available to Member States on request. The similar work for other types of ships was not considered as being necessary at this stage, since a predominant part of the content of any further work for other types of ships could be very similar to the current tier I. REQUIREMENTS FOR ACCESS TO, OR ELECTRONIC VERSIONS OF, CERTIFICATES AND DOCUMENTS, INCLUDING RECORD BOOKS REQUIRED TO BE CARRIED ON SHIPS (AGENDA ITEM 4) Following the approval of Guidelines for the use of electronic certificates (FAL.5/Circ.39/Rev.1), MEPC 67 and MSC 94 instructed the SubCommittee to consider amending FAL.2/Circ.127MEPC.1/Circ.817 MSC.1/Circ.1462 on "List of certificates and documents required to be carried on board ships" so as to reflect this understanding. In this regard, III 2 decided that the amendments to FAL.2/Circ.127MEPC.1/Circ.817MSC.1/Circ.1462 are not needed this time. Attachment of Technical Information No: 038-2015 Page 3 of 5
The need might arise later based on the outcome of the consideration by MEPC 69 of the use of electronic record books under MARPOL and the work of the Correspondence Group on Electronic Access to Certificates and Documents which FAL 39 decided to reestablish. UPDATED SURVEY GUIDELINES UNDER THE HARMONIZED SYSTEM OF SURVEY AND CERTIFICATION (HSSC) (AGENDA ITEM 9) The work on reviewing and updating the survey guidelines under the Harmonized System of Survey and Certification (HSSC) have been conducting since its adoption by Assembly Resolution A.746(18). In relation with above matter, the SubCommittee agreed to draft Amendments to Survey Guidelines covering: 1. the requirements deriving from amendments to relevant IMO instruments entering into force up to and including 31 December 2015 2. a new paragraph 4.8.3 covering guidance for cases where deficiencies, other than those described in paragraphs 4.8.1 and 4.8.2 3. amendments to (CIn) 2.3.2.3 of Annex 1 regarding the examination of selected cargo spaces of gas carriers at intermediate surveys for ships over 10 years of age 4. new survey items regarding the verification of an appropriate atmosphere testing instruments for enclosed spaces and its calibration Regarding alignment of the survey regime for ships not subject to the enhanced survey programme of inspections (ESP) of bulk carriers and oil tankers with that of ships subject to it, to align the survey intervals of the intermediate survey, the SubCommittee agreed to the draft amendments to SOLAS XI1/2 and the Survey guidelines. The amendments will be submitted to MSC 96 for approval and adoption. In addition, the SubCommittee also agreed to draft amendments to MARPOL Annexes I, IV and VI related to the exemption of the Unmanned NonSelfPropelled (UNSP) barges from survey and certification requirements. The amendments will be submitted to MEPC 69 for approval and subsequent adoption. UNSP barge which is entitled to the above exemption is a barge that: 1. is not propelled by mechanical means 2. has neither crew nor passengers or other persons on board during navigation 3. carries no oil (as defined in MARPOL Annex I, regulation 1.1) in bulk 4. carries no noxious liquid substances (as defined in MARPOL Annex II, regulation 1.10) in bulk 5. has no machinery installed that may generate oil residues 6. has no fuel oil tank, lubricating oil tank and bilge/oil residues tank 7. has no system, equipment and/or machinery installed that may generate emissions controlled by MARPOL Annex VI 8. has undergone a survey to confirm the above conditions are met Attachment of Technical Information No: 038-2015 Page 4 of 5
NONEXHAUSTIVE LIST OF OBLIGATIONS UNDER INSTRUMENTS RELEVANT TO THE IMO INSTRUMENTS IMPLEMENTATION CODE (III CODE) (AGENDA ITEM 10) The SubCommittee agreed to the amendments to the 2013 Nonexhaustive list of obligations under instruments relevant to the IMO Instruments Implementation Code (III Code) (resolution A.1077(28)) and prepared the text of a draft Assembly resolution, for submission to A 29 for adoption. INFORMASI SINGKAT DARI IMO SUBCOMMITTEE ON IMPLEMENTATION OF IMO INSTRUMENTS SESI KE2 (III 2) NONMANDATORY INSTRUMENTS ON REGULATIONS FOR NONCONVENTION SHIPS (AGENDA ITEM 3) Dalam mempromosikan dan meningkatkan aspek keselamatan maritim terkait kapal nonkonvensi, termasuk kapal ikan kecil dan ferry penumpang domestic, satu set regulasi standar dan harmonis dan model peraturan nasional untuk kapal yang tidak terkena aturan konvensi SOLAS 1974 (yang disebut sebagai GlobalReg ) telah dikembangkan melalui konsultasi dan model kursus dasar dalam lingkup kerja sama teknik (Technical Cooperation). Dari diskusi terkait hal tersebut di atas yang dilakukan pada sidang Komite dan SubKomite, setujui bahwa pada tahap awal, aturan tidak wajib (nonmandatory) untuk standar keselamatan untuk kapal nonkonvensi terbatas pada peraturan umum dan peraturan spesifik untuk kapal penumpang yang nonkonvensi. Selanjutnya, setujui juga bahwa GlobalReg tidak ditujukan untuk melemahkan standar regional, bilateral dan nasional yang telah ada. Pekerjaan untuk GlobalReg dilakukan atas dasar sistem dua Tier. Pada III 2, SubKomite telah mereview dan mengesahkan Panduan untuk mengatur keselamatan kapal penumpang yang tidak terkena aturan SOLAS, yang berisi prinsip umum dan persyaratan fungsional untuk menyusun peraturan nasional dan regional untuk sertifikasi keselamatan kapal penumpang sebagai penyelesaian dari pekerjaan pada Tier 1. Sebagai tambahan, III 2 menyetujui bahwa draft Panduan tersebut sebaiknya disirkulasikan sebagai lampiran pada laporan sidang III 2. Panduan tersebut akan tersedia bagi Negara Anggota berdasarkan permintaan. Pekerjaan yang sama untuk kapal tipe lain dianggap masih belum diperlukan pada tahap ini, dikarenakan sebagian besar dari konten untuk pekerjaan lanjutan untuk tipe kapal lain dapat memiliki kesamaan dengan Tier 1 yang ada sekarang ini. REQUIREMENTS FOR ACCESS TO, OR ELECTRONIC VERSIONS OF, CERTIFICATES AND DOCUMENTS, INCLUDING RECORD BOOKS REQUIRED TO BE CARRIED ON SHIPS (AGENDA ITEM 4) Menindaklanjuti persetujuan atas panduan untuk penggunaan sertifikat elektronik (Guidelines for the Use of Electronic Certificates (FAL.5/Circ.39/Rev.1)), MEPC dan MSC 94 menginstruksikan kepada SubKomite untuk mempertimbangkan mengamandemen FAL.2/Circ.127MEPC.1/Circ.817MSC.1/Circ.1462 mengenai daftar sertifikat dan dokumen yang dipersyaratkan untuk disimpan di atas kapal (List of certificates and documents required to be carried on board ships) untuk dapat mencerminkan pemahaman mengenai penggunaan sertifikat elektronik. Berkaitan dengan hal tersebut, III 2 memutuskan bahwa amandemen terhadap FAL.2/Circ.127 MEPC.1/Circ.817MSC.1/Circ.1462 masih belum dibutuhkan saat ini. Kebutuhan untuk mengamandemen mungkin dibutuhkan nantinya berdasarkan hasil dari MEPC 69 untuk penggunaan buku catatan elektronik untuk MARPOL dan berdasarkan pekerjaan dari Grup Korespondesi untuk Access to Certificates and Documents yang dibentuk kembali oleh FAL 39. UPDATED SURVEY GUIDELINES UNDER THE HARMONIZED SYSTEM OF SURVEY AND CERTIFICATION (HSSC) (AGENDA ITEM 9) Pekerjaan untuk mereview dan memperbarui Survey Guidelines di bawah Harmonized System of Survey and Certification (HSSC) telah dilakukan sejak pengadopsian panduan tersebut oleh resolusi Assembly A.746(18). Berkaitan dengan hal tersebut di atas, SubKomite telah menyetujui draft amandemen terhadap Survey Guidelines yang mencakup: 1. Persyaratan yang diambil dari amandemen terhadap peraturan IMO yang akan diberlakukan sampai dengan dan termasuk tanggal 31 Desember 2015. 2. Paragraf 4.8.3 yang mencakup panduan untuk kasus dimana defisiensi, selain yang dinyatakan pada paragraf 4.8.1 dan 4.8.2. 3. Amandemen terhadap (CIn) 2.3.2.3 pada Annex 1 terkait pengujian dari ruangan muat yang dipilih pada kapal pengangkut gas pada saat pelaksanaan survey antara untuk kapal berumur 10 tahun atau lebih. 4. Item survey baru terkait verifikasi dari alat penguji atmosfir yang sesuai untuk ruang tertutup dan kalibrasinya. Terkait penyelarasan dari rezim survey antara kapal yang tidak terkena aturan Enhanced Survey Programme of Inspections (ESP) untuk Bulk Carrier dan Oil Tanker dengan kapal yang terkena aturan tersebut, untuk menyelaraskan interval survey dari survey antara, SubKomite telah menyetujui draft amandemen terhadap SOLAS regulasi XI1/2 dan Survey Guidelines. Amandemen tersebut akan dimasukkan ke MSC 96 untuk persetujuan dan adopsi. Sebagai tambahan, SubKomite juga menyetuji draft amandemen terhadap MARPOL Annex I, IV dan VI mengenai pemberian pembebasan terhadap persyaratan survey dan serfitikasi untuk tongkang tidak berawak yang tidak berpenggerak (Unmanned Non*Self*Propelled (UNSP)). Amandemen tersebut akan akan dimasukkan ke MEPC 69 untuk persetujuan dan adopsi. Lampiran dari Informasi Teknik No. 038-2015 Page 4 of 5
Tongkang UNSP yang berhak mendapatkan pembebasan seperti yang tersebut di atas adalah tongkang yang: 1. tidak dilengkapi dengan mesin penggerak 2. tidak mengangkut awak kapal, penumpang maupun personil lain selama berlayar. 3. tidak mengangkut minyak curah (seperti yang dijelaskan pada MARPOL Annex I, Regulasi 1.1) 4. tidak membawa cairan berbahaya curah (seperti yang dijelaskan pada MARPOL Annex II, Regulasi 1.10) 5. tidak dilengkapi dengan permesinan yang dapat menghasilkan minyak sisa 6. tidak memiliki tangki bahan bakar, tangki minyak pelumas dan tangki bilga/minyak sisa 7. tidak memiliki sistem, peralatan, dan atau permesinan yang dipasang yang dapat menimbulkan emisi yang diatur pada MARPOL Annex VI 8. telah disurvey untuk mengkonfirmasi semua kondisi di atas terpenuhi.
