KONTRIBUSI KRIMINOLOGI UNTUK AHLI HUKUM PIDANA DALAM MEMBERIKAN LEGAL OPINION DAN KETERANGAN AHLI TERHADAP PENANGANAN PERKARA PIDANA Rehnalemken Ginting Abstract Anycorruption casesfound in Indonesia need to behandledseriouslyby those who uphold the law, in this case: police, attorney, andjudicialaffairs. Forsolong, the handlings ofthe corruption cases tend to go far beyond the justice that finally the society lose their trust to those agencies. In order to anticipate that situation and condition, the expert's explanations are needed to look atthe corruption cases scientifically. The expert's explanations are usuallyrelated to constitutionallawandcriminallaw, while some otherexpert's explanations are the expert's explanations from the people who work in BPKand BPKP to see whether or not there is a detriment In general, the explanation from the constitutional law expert isneeded to see that the misuse ofthe authorityisacriminalact, while the explanation from the criminallaw expertisneeded to define whether the corruption is consideredas a criminal act ornot. Furthermore, to deepen and broaden the analysis that isdone bythe criminal law expert, criminology is needed. Thus, a certain corruption case is then analyzed not only basedoncriminology study and but also criminal law study. The method that was used to conduct this research was doctrinal research, which was also based on sociology and analyzeddescriptively. Based on theresult of theresearch, itcould be concluded that a criminal lawexpert, ingiving legal opinions and any expert's explanations, should beable convince that the corruption isa criminal act. The using ofcriminology as the auxiliary studies ofcriminal law would help the expert to present a scientific analysis towardthe corruption case. Keywords: corruption, criminal law, andcriminology. A. Pendahuluan Dalam tenggang waktu antara tahun 1999 sampai dengan tahun 2004, tepatnya setalah reformasi dan jatuhnya pemerintahan Orde Baru, maka era demokrasi yang sesungguhnya dimulai, setelah lebih daritiga dekade dibelenggu oleh rejim yangberkuasawaktu itu. Para wakil rakyat, kepala daerah yang terpilih secara demokratis, bahkan menteri-menteri dalam pemerintahan kurun waktu tersebut diatas, ternyatatidak dapat mengelak dari keteriibatan untuk melakukan korupsi. Seharusnya di era reformasi, penyakit-penyakit sosial seperti KKN (Korupsi, Kolusi, dan Nepotisme) dapat diberantas,agar NKRI tidaktenggelamatau bubar, akibat ulah individu atau kelompoktertentu. Untukmenanggulangi korupsi, berbagai upaya dilakukan, mulaidari pembenahan undang-undang pemberantasan korupsi yang sudah ketinggalan dibandingkan dengan perkembangan masyarakat, peningkatan profesionalisme aparat penegak hukum, serta kerjasama dengan instansi-instansi terkait memerangi patologi sosial yang satu ini. Hasilnya meskipun ada, tetapi belum memadai. Memang hams diakui, korupsi bukanlah kejahatan yang gampang untukditangani. Meskipun aparat penegak hukum, baik itu penyidik polisi, maupun jaksa bahkan KPK sekalipun, telah mendapat pendidikan keahlian khusus untuk penanganan tindakpidana korupsi Bukan hanya Indonesia yang merasakan kesulitan mengatasi masalah korupsi, negaranegaradiluar negeri punmengalami halyangsama. Konggres PBB ke VI mengenai The Prevention of Crime and Treatment of Offenders, tahun 1980 mengklasifikasikan korupsi sebagai jenis tindak pidana yang sulit dijangkau hukum (offences be yond the reach of the law). Selanjutnya dalam konggres tersebut dikemukakan, bahwa aparat penegak hukum relatif tidak berdaya atau tidak mempunyai kekuatan menghadapi jenis tindak pidana ini, dikarenakan ada dua alas an utama, yaitu: Pertama, kedudukan ekonomi atau politikyang kuat dari si pelaku (the high economic or political status of the perpetrators); Kedua, Keadaan-keadaan sekitar perbuatan yangmereka lakukan itu sedemikian rupasehingga mengurangi kemungkinan merekauntuk dilaporkan Yustisla Edisi Nomor 74 Mei - Agustus 2008 Kontribusi Kriminologi untuk Ahli Hukum...
