MEMORANDUM SALING PENGERTIAN ANTARA PEMERINTAH REPUBLIK INDONESIA DAN PEMERINTAH REPUBLIK KOLOMBIA MENGENAI PEMBENTUKAN KOMISI BERSAMA Pemerintah Republik Indonesia dan Pemerintah Republik Kolombia selanjutnya disebut sebagai "Para Pihak"; MENEGASKAN keinginan mereka dalam memperkuat keqasama bilateral antara kedua negara berdasarkan pnns1p-pnns1p kesetaraan, saling menguntungkan dan penghormatan secara penuh terhadap kedaulatan; MENGACU pada Persetujuan antara Pemerintah Republik Indonesia dar. Pemerintah Republik Kolombia mengenai Kerjasama Ekonomi dan Teknis yang ditandatangani pad~ 13 Oktober 1999; SESUAI DENGAN hukum dan peraturan yang berlaku d: masing-masing negar&; TELAH MENYETUJUI hal-hal sebagai berikut: PASALI Komisi Bersama antara Pemerintah Republik Indonesia dan Pemerintah Republ:k Kolombia bersama ini dibentuk untuk memfasilitasi pertukaran dialog, perumusan dan implementasi dari inisiatif-inisiatif, proyek dan usulan-usulan lainnya dengan tujuan untuk memperdalam dan memperluas pengembangan aksi-aksi kerjasama konkret pada Kerjasama Ekonomi dan Teknis antara kedua negara. PASAL!I Komisi Bersama akan memiliki fungsi sebagai berikut a. Mengkaji ulang dan mengevaluasi situasi dari Perjan.iian-Perjanjian dan Persetujuan Persetujuan kerjasama antara kedua negara; b. Mendorong penyelesaian Perjanjian-Perjanjian can Persetujuan-Persetujuan Kerjasama di bidang perdagangan, ekonomi, ilmu pengetahuan, buaaya dan bidang kerjasama lainnya yang disetujui bersama oleh Para Pihak sesuai dengan Persetujuan Kerjasama Teknis dan Ekonomi antara Pemerintah Repub!ik 11d Jnesia dan Pemerintah Republik Kolombia pada tanggal 13 Oktober 1999. c. Mengidentifikasi, menganalisa, dan mengevaluasi bidang-bidang pertukaran d~n kerjasama baru yang dapat memperluas cak1;pan kepentingan dari kedua negara. d. Mengusulkan mekanisme yang akan memfasilitasi dan mempercepat implementasi dari Perjanjian-Perjanjian dan Persetujuan-PersetujL!an yang telah ditandatangani kedua negara.
e. Menyetujui program kerjasama bilateral yang akan dilaksanakan dalam jangka waktu dua tahun. Mengevaluasi perkembangan proyek-proyek yang telah disetuju1 oleh Para Pihak dalam Sidang Komisi Bersama. PASAL Ill 1. Komisi Bersama wajib diketuai pada tingkat Pejabat Senior dengan jabatan setingkat Wakil Menteri atau Direktur Jenderal dan terdiri dari perwakilan-perwakilan dari sektorsektor pemerintah yang berpartisipasi dalam pengembangan program-program kerjasama antara kedua negara. 2. Komisi Bersama dapat mengundang perwakilan non pemerintah dengan kompetensi yang relevan untuk berurusan dengan dengan hal-hal yang termasuk dalam agenda apabila dianggap perlu. PASAL IV 1. Komisi Bersama wajib bertemu dalam waktu yang telah disepakati oleh Para Pihak yang akan dikomunikasikan melalui saluran diplomatik, secara bergantian di Republik Indonesia dan Republik Kolombia. 2. Komisi Bersama wajib menentukan aturan-aturan dan prosedur-prosedurnya dan dapat membentuk komite-komite, sub komite-sub komite, dan/atau kelompok kerja untuk menangani isu-isu spesifik, untuk menindaklanjuti hasil-hasil pertemuan Kom is1 Bersama dan melaporkan kemajuan dari isu-isu kerjasama spesifik tersebut kepada Komisi Bersama. 3. Hasil dan pertemuan Komis1 Bersama yang telah disetujui oleh Pa ra Pihak wajib dituangkan dalam bentuk Butir-butir Kesepakatan. PASAL V Memorandum Saling Pengertian ini dapat diubah setiap saat melalui persetujuan tertulis dari Para Pihak. Perubahan tersebut wajib berlaku sejak tanggal yang telah ditetapkan oleh Para Pihak dan akan menjadi bagian tidak terpisahkan dari Memorandum Saling Pengertian ini PASAL VI Setiap perselisihan yang timbul di antara Para Pihak mengenai interpretasi dan implementasi dari Memorandum Saling Pengertian ini akan diselesaikan secara dama1 melalu1 konsultasi atau negosiasi antara Para Pihak. PASAL VII Memorandum Saling Pengertian ini akan berlaku sejak tanggal ditandatangani dan akan berlaku untuk jangka waktu lima tahun. Memorandum Saling Pengert1an ini akan diperbaharui secara otomatis untuk jangka waktu yang sama, kecuali salah satu pihak memberitahukan secara tertulis keinginan untuk mengakhiri Memorandum Saling Pengertian im enam bulan sebelum masa berakh1rnya.
MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF REPUBLIC OF COLOMBIA FOR THE ESTABLISHMENT OF A JOINT COMMISSION The Government of the Republic of Indonesia and the Gcvernment of the Republic of Colombia hereinafter referred to as "The Parties". Confirming their interest in strengthening bilateral cooperation between the two countries based on the principles of equality, mutual benefit, and full respect of sovereignty; Referring to the Agreement between the Government of the Republic of Indonesia and the Government of the Republic of Colombia on Economic and Technical cooperation; signed on October 13, 1999; Pursuant to the prevailing laws and regulations of their respective countries; Have agreed as follows: ARTICLE I A Joint Commission between the Government of the Republic of Indonesia and the Government of the Republic of Colombia is hereby esfablished to facilitate dialogue exchange, formulation and implementation of initiatives, project and other proposals, with the view of deepening and widening the development of concrete actions of cooperation on Economic and Technical Cooperation between both countries. ARTICLE II The Joint Commission will have the following functions: a. To reviews and evaluate the situation of the Treaties and Agreements for cooperat!on between both countries; b. To promote the conclusion of Treaties and Agreements for Ccoperation in the areas of trade, economics, science, technology, culture and other areas as may mutu:~liy agreed by The Parties in accordance with the Technical and Economic Cooperation Agreement between the Government of the Republic of Indonesia and the Republic of Colombia on October 13 1 h 1999. c. To identify, analyze and evaluate new areas of exchange and cooperation that allow expanding the scope of interests between both countries; d. To propose mechanism which will facilitate and expedite the efficient implementation of Treaties and Agreements signed by both countries. e. To approve the bilateral cooperation program to be executed in a two year period. f. To evaluate the development of the projects agreed upon by the Parties during the Joint Commission Meeting.
ARTICLE Ill 1. The Joint Commission shall be headed at the Senior Official level with the rank of Deputy Minister or Director General and composed of representatives of governmental sectors participating in the development of cooperation programs between both countries. 2. The Joint Commission may invite non governmental representatives with relevant competence to deal with the items included in the agenda as deemed necessary. ARTICLE IV 1. The Joint Commission shall meet at a time agreed upon by the Parties which shall be communicated through diplomatic channel alternately in the Republic of Indonesia and the Republic of Colombia. 2. The Joint Commission shall determine its rules and orocedures and may establish committees. sub committees, and/or working groups to deal with specific subject before it, to follow up the result of the Joint Commtssion meetings and to report the progress on such specific subject of cooperation tg the Joint Commission. 3. The result of the meeting of Joint Commission which is agreed upon by The Parties shall be in the form of Agreed Minutes. ARTICLE V This Memorandum of Understanding may be amended at any time by mutual written consent of The Parties. Such amendment shall come into force or. the date determined by The Parties and shall be an integral part of this Memorandum of Understanding. ARTICLE VI Any disputes arising between The Parties concerning the interpretation or implementation of this Memorandum of Understanding should be settled amicably through consultations or negotiations between The Parties. ARTICLE VII 1. The Memorandum of Understanding shall come irito force on the date of its signing and shall retain in force for the period of five years. it shall be automatically renewed consecutively fer the same period unless either PCJrty wishes to terminate th's Memorandum of Understanding by giving no~ificc:1tion six mor.ths prior to such termination. 2. The termination of the Memorandum of Understandi'ig shall 11ot affect the validity and duration of any activity made under the MemorandL:rn of Understanding until the completion of such activity, unless The Pa1iies agreed otherwise.
