Ket~ntuan ini j~ga berlaku bagi seluruh anggota ofganisasi irternasional dari salah satu Pihak yang adalah pemegang pa~pqr ~ip lomat!k dan dinas yang masih berlaku.
Pasal3 Warganegara dari para Pihak merujuk pada pasal 1 dan 2 dari Persetujuan ini boleh memasuki atau meninggalkan wilayah Negara Pihak lainnya pada setiap lintas perbatasan yang ditentukan sebagai jalur internasional, apabila mereka memenuhi syarat-syarat yang diperlukan yang diatur oleh hukum nasional dari para Pihak berkenaan dengan masuk, perpindahan atau tinggalnya orang asing. Pasal4 Berdasarkan Persetujuan ini, warga negara salah satu Pihak diwajibkan untuk menghormati hukum dan peraturan perundangan yang berlaku di wilayah negara dari pihak lain. Pasal5 Persetujuan in! tidak akan membatasi hak dari pejabat yang berwenang dari para Pihak untuk menolak masuk atau tinggal bagi pemegang paspor diplomatik dan dinas dari Pihak yang lain merujuk pada pasal 1 dan 2 Persetujuan, asalkan orang-orang itu dianggap persona non grata tanpa memberikan alasan-alasan keputusannya. Pasal6 1. Para Pihak melakukan pertukaran melalui saluran diplomatik, contoh paspor diplomatik atau dinas yang berlaku yang tunduk pada ketentuanketentuan Persetujuan ini tidak lebih dari 30 hari sebelum masa berlakunya Persetujuan ini. 2. Jika paspor diplomatik, dinas atau khusus yang baru diperkenalkan atau dalam hal paspor - paspor yang berlaku akan diganti, maka para Pihak akan menyampaikan contoh paspornya melalui saluran diplomatik tidak lebih dari 30 hari sebelum paspor tersebut secara resmi diberlakukan. Pasal7 Dalam hal warganegara satu Pihak kehilangan paspornya di wilayah Pihak lain, ia harus memberitahu pejabat-pejabat yang berwenang negara tuan rumah untuk mengambil tindakan yang diperlukan. Misi Diplomatik atau Konsulat yang terkait akan menerbitkan paspor baru atau dokumen perjalanan terhadap warganegaranya dan memberitahu pejabat-pejabat yang berwenang Pemerintah setempat.
Pasal8 Dalam hal adanya ketidaksepakatan yang timbul dari pelaksanaan dan penafsiran Persetujuan ini akan diselesaikan melalui saluran diplomatik. Pasal9 Persetujuan ini akan berlaku enam puluh (60) hari sejak tanggal penerimaan pemberitahuan terakhir di mana para Pihak saling memberitahukan melalui saluran diplomatik bahwa seluruh persyaratan sebagaimana diatur dalam peraturan perundangan nasional bagi berlakunya Persetujuan ini telah dipenuhi. Pasal10 Salah satu Pihak dapat menangguhkan seluruh atau sebagian pelaksanaan Persetujuan ini karena alasan keamanan atau ketertiban atau untuk melindungi kesehatan masyarakat. Melalui saluran diplomatik, para Pihak harus saling memberitahukan segera mengenai penangguhan tersebut di atas atau kelanjutan untuk melaksanakan Persetujuan ini. Pasal11 Persetujuan ini akan tetap berlaku selama lima (5) tahun dan dapat diperbaharui lagi untuk masa lima tahun berikutnya atas dasar kesepakatan bersama secara tertulis. Masing-masing Pihak boleh mengakhiri Persetujuan ini setiap saat dengan memberitahukan Pihak lain melaui saluran-saluran diplomatik dan Persetjuan ini akan berhenti berlaku enam puluh (60) hari sejak tanggal penerimaan pemberitahuan tersebut. Sebagai bukti, yang bertanda tangan, menandatangani Persetujuan ini. DIBUAT di Jakarta pada hari ini tanggal dua puluh tiga bulan Oktober tahun dua ribu tiga dalam dua rangkap dalam bahasa Indonesia, Serbia dan lnggris, seluruh naskah mempunyai kekuatan hukum yang sama. AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE COUNCIL OF MINISTERS OF SERBIA MONTENEGRO ON VISA EXEMPTION FOR HOLDERS OF DIPLOMATIC AND OFFICIAL PASSPORTS The Government of the Republic of Indonesia and the Council of Ministers of Serbia and Montenegro (hereinafter referred to as the contracting Parties), wishing to promote their bilateral relations and with a view to facilitating the travel of citizens of the two contracting Parties, have agreed as follows: Article 1 Citizens of one contracting Party, who are holders of valid diplomatic or official passports, shall be exempted from a visa requirement for entry into, exit from and transit through the territory of the State of the other contracting Party and shall be allowed to stay there for maximum period of (fourteen} 14 days. The duration of passport validity of citizen of contracting Parties shall be at least (six) 6 months before entering on the territory of other contracting Party. Article 2 Citizen of one contracting Party, holders of valid diplomatic or official passports, and members of the diplomatic mission or consular posts located in the territory of the State of other contracting Party and member of their families forming part of their household who hold diplomatic or official passports shall be required to obtain an entry visa of the receiving State. Upon assumption of their duties in diplomatic or consular missions, above mentioned persons may freely leave and enter the territory of the State of other contracting Party without visa requirement, as far as their stay permit still -valid. This provision shab also apply to all the members of the international.organizations of one contracting Party, who are holders of valid diplomatic or official passport. Article 3 Citizens of the contracting Parties referred to in Articles 1 and 2 of this Agreement may enter or leave the territory of State of the other contracting Party at any border crossing designated for international traffic, if they fulfill necessary conditions prescribed by national laws of the contracti;1g Parties with respect to the entry, movement or stay of foreigners.
Article 4 Under this Agreement, citizens of either contracting Party shall be obliged to observe the laws and regulations in force in the territory of the State of the other contracting Party. Article 5 This Agreement shall not restrict the right of the competent authorities of the Parties to refuse the entry or leave to stay to the holders of diplomatic or official passports of the other contracting Party referred to in Articles 1 and 2 of this Agreement, provided that those persons are considered as personae non grata, without providing reasons for their dec~sion. Article 6 1. The contracting Parties shall exchange, through diplomatic channels, specimens of their valid diplomatic or official passports subject to the provis~ons of this Agreemen~ :1ot later than thirty (30) days before entry into force of this Agreement. 2. If new diplomatic. official, or special passports are introduced, or the existing ones are changed, the contracting Parties shall exchange their specimen through diplomatic channets not later than thirty (30) days before they have been formally introduced. Article 7 If citizen of one contracting Party loses his, her passport in the territory of other contracting Party; he, she shall inform the authorities concerned of the host country for appropriate action. The Diplomatic Mission or Consulate concerned will issue a fresh passport or travel document to its citizen and inform the concerned authorities of the local Government. Article 8 Disagreement ansmg out of the implementation and interpretation of this Agreement shall be settled through diplomatic channels. Article 9 This Agreement shall enter into force sixty (60) days from date of the receipt of the last notification in which the contracting Parties have informed each other through diplomatic channels that conditions prescribed by their national laws for entry into force of this Agreement, have been fulfilled.
Article 10 Either contracting Party may suspend, entirely or partially, the execution of this Agreement for security reasons or to protect pubi,c order or health. Through the diplomatic channels, the contracting Partie$ shall promptly notify one another of said suspension or resumption to imp!ement this Agreement. Artlde 11 This Agreement shall remain in force a pet~od of five (5) years and may be renewed for further periods of fi've (5) y@-ars by mutual consent in writing.
